INJURED AS A RIDESHARE PASSENGER OR AT THE FAULT OF A DELIVERY DRIVER? KNOW YOUR RIGHTS!
One simple click and you can be on the road or waiting leisurely at home for your favorite food delivery. Ridesharing companies like Uber or Lyft have become widespread services. And anything you need to be delivered is at your fingertip with Postmates, Uber Eats, Instacart, GrubHub, and more! While on-demand delivery services are much-needed for many people, the trend has not been without its problems.
The increase of rideshare and food delivery services have resulted in more accidents due in part to the increase of drivers who are not professionally trained. Drivers who offer ridesharing and/or deliveries are contractors and can simply sign up through an app. In fact, drivers can sometimes get hired without proper background checks. This has resulted in more frequent accidents where passengers are hurt or seriously injured. Many of these drivers are underinsured (a recent survey found 13% of all drivers were underinsured), so it’s important to know your rights if you are injured as a ridesharing passenger or at the fault of a delivery driver.
App-based drivers are also working under time constraints that can cause distraction and recklessness. Accidents occur due to speeding to avoid being late, fatigue from being on call at all hours, and distracted driving due to constantly checking their apps or GPS device.
